But what will Obama plead? The Administration, just months ago, asked Congress to provide a $4 billion loan guarantee for two new nuclear reactors to be built and operated on the Gulf Coast of Texas -- by Tokyo Electric Power and local partners. As if the Gulf hasn't suffered enough.

Here are the facts about Tokyo Electric and the industry you haven't heard on CNN:

The failure of emergency systems at Japan's nuclear plants comes as no surprise to those of us who have worked in the field.

Nuclear plants the world over must be certified for what is called "SQ" or "Seismic Qualification." That is, the owners swear that all components are designed for the maximum conceivable shaking event, be it from an earthquake or an exploding Christmas card from Al Qaeda.

The most inexpensive way to meet your SQ is to lie. The industry does it all the time. The government team I worked with caught them once, in 1988, at the Shoreham plant in New York. Correcting the SQ problem at Shoreham would have cost a cool billion, so engineers were told to change the tests from 'failed' to 'passed.'

The company that put in the false safety report? Stone & Webster, now the nuclear unit of Shaw Construction which will work with Tokyo Electric to build the Texas plant, Lord help us.

There's more.

Last night I heard CNN reporters repeat the official line that the tsunami disabled the pumps needed to cool the reactors, implying that water unexpectedly got into the diesel generators that run the pumps.

These safety back-up systems are the 'EDGs' in nuke-speak: Emergency Diesel Generators. That they didn't work in an emergency is like a fire department telling us they couldn't save a building because "it was on fire."

What dim bulbs designed this system? One of the reactors dancing with death at Fukushima Station 1 was built by Toshiba. Toshiba was also an architect of the emergency diesel system.

Now be afraid. Obama's $4 billion bail-out-in-the-making is called the South Texas Project. It's been sold as a red-white-and-blue way to make power domestically with a reactor from Westinghouse, a great American brand. However, the reactor will be made substantially in Japan by the company that bought the US brand name, Westinghouse -- Toshiba.

I once had a Toshiba computer. I only had to send it in once for warranty work. However, it's kind of hard to mail back a reactor with the warranty slip inside the box if the fuel rods are melted and sinking halfway to the earth's core.

TEPCO and Toshiba don't know what my son learned in 8th grade science class: tsunamis follow Pacific Rim earthquakes. So these companies are real stupid, eh? Maybe. More likely is that the diesels and related systems wouldn't have worked on a fine, dry afternoon.

Back in the day, when we checked the emergency back-up diesels in America, a mind-blowing number flunked. At the New York nuke, for example, the builders swore under oath that their three diesel engines were ready for an emergency. They'd been tested. The tests were faked, the diesels run for just a short time at low speed. When the diesels were put through a real test under emergency-like conditions, the crankshaft on the first one snapped in about an hour, then the second and third. We nicknamed the diesels, "Snap, Crackle and Pop."

(Note: Moments after I wrote that sentence, word came that two of three diesels failed at the Tokai Station as well.)

In the US, we supposedly fixed our diesels after much complaining by the industry. But in Japan, no one tells Tokyo Electric to do anything the Emperor of Electricity doesn't want to do.

I get lots of confidential notes from nuclear industry insiders. One engineer, a big name in the field, is especially concerned that Obama waved the come-hither check to Toshiba and Tokyo Electric to lure them to America. The US has a long history of whistleblowers willing to put themselves on the line to save the public. In our racketeering case in New York, the government only found out about the seismic test fraud because two courageous engineers, Gordon Dick and John Daly, gave our team the documentary evidence.

In Japan, it's simply not done. The culture does not allow the salary-men, who work all their their lives for one company, to drop the dime.

Not that US law is a wondrous shield: both engineers in the New York case were fired and blacklisted by the industry. Nevertheless, the government (local, state, federal) brought civil racketeering charges against the builders. The jury didn't buy the corporation's excuses and, in the end, the plant was, thankfully, dismantled.

Am I on some kind of xenophobic anti-Nippon crusade? No. In fact, I'm far more frightened by the American operators in the South Texas nuclear project, especially Shaw. Stone & Webster, now the Shaw nuclear division, was also the firm that conspired to fake the EDG tests in New York. (The company's other exploits have been exposed by their former consultant, John Perkins, in his book, Confessions of an Economic Hit Man.)

If the planet wants to shiver, consider this: Toshiba and Shaw have recently signed a deal to become world-wide partners in the construction of nuclear stations.

The other characters involved at the South Texas Plant that Obama is backing should also give you the willies. But as I'm in the middle of investigating the American partners, I'll save that for another day.

So, if we turned to America's own nuclear contractors, would we be safe? Well, two of the melting Japanese reactors, including the one whose building blew sky high, were built by General Electric of the Good Old US of A.

After Texas, you're next. The Obama Administration is planning a total of $56 billion in loans for nuclear reactors all over America.

And now, the homicides:

CNN is only interested in body counts, how many workers burnt by radiation, swept away or lost in the explosion. These plants are now releasing radioactive steam into the atmosphere. Be skeptical about the statements that the "levels are not dangerous." These are the same people who said these meltdowns could never happen. Over years, not days, there may be a thousand people, two thousand, ten thousand who will suffer from cancers induced by this radiation.

In my New York investigation, I had the unhappy job of totaling up post-meltdown "morbidity" rates for the county government. It would be irresponsible for me to estimate the number of cancer deaths that will occur from these releases without further information; but it is just plain criminal for the Tokyo Electric shoguns to say that these releases are not dangerous. Indeed, the fact that residents near the Japanese nuclear plants were not issued iodine pills to keep at the ready shows TEPCO doesn't care who lives and who dies whether in Japan or the USA. The carcinogenic isotopes that are released at Fukushima are already floating to Seattle with effects we simply cannot measure.

Heaven help us. Because Obama won't.

In February 2003, a month before the U.S. invasion of Iraq, a 101-page document came my way from somewhere within the U.S. State Department. Titled pleasantly, "Moving the Iraqi Economy from Recovery to Growth," it was part of a larger under-wraps program called "The Iraq Strategy."

The Economy Plan goes boldly where no invasion plan has gone before: the complete rewrite, it says, of a conquered state's "policies, laws and regulations." Here's what you'll find in the Plan: A highly detailed program, begun years before the tanks rolled, for imposing a new regime of low taxes on big business, and quick sales of Iraq's banks and bridges--in fact, "ALL state enterprises"--to foreign operators. There's more in the Plan, part of which became public when the State Department hired consulting firm to track the progress of the Iraq makeover. Example: This is likely history's first military assault plan appended to a program for toughening the target nation's copyright laws.

And when it comes to oil, the Plan leaves nothing to chance--or to the Iraqis. Beginning on page 73, the secret drafters emphasized that Iraq would have to "privatize" (i.e., sell off) its "oil and supporting industries." The Plan makes it clear that--even if we didn't go in for the oil--we certainly won't leave without it.

If the Economy Plan reads like a Christmas wishlist drafted by U.S. corporate lobbyists, that's because it was.

From slashing taxes to wiping away Iraq's tariffs (taxes on imports of U.S. and other foreign goods), the package carries the unmistakable fingerprints of the small, soft hands of Grover Norquist.

Norquist is the capo di capi of the lobbyist army of the right. In Washington every Wednesday, he hosts a pow-wow of big business political operatives and right-wing muscle groups--including the Christian Coalition and National Rifle Association--where Norquist quarterbacks their media and legislative offensive for the week.

Once registered as a lobbyist for Microsoft and American Express, Norquist today directs Americans for Tax Reform, a kind of trade union for billionaires unnamed, pushing a regressive "flat tax" scheme.

Acting on a tip, I dropped by the super-lobbyist's L-Street office. Below a huge framed poster of his idol ("NIXON-- NOW MORE THAN EVER"), Norquist could not wait to boast of moving freely at the Treasury, Defense and State Departments, and, in the White House, shaping the post-conquest economic plans--from taxes to tariffs to the "intellectual property rights" that I pointed to in the Plan.

Norquist wasn't the only corporate front man getting a piece of the Iraq cash cow. Norquist suggested the change in copyright laws after seeking the guidance of the Recording Industry Association of America.

And then there's the oil. Iraqi-born Falah Aljibury was in on the drafting of administration blueprints for a post-Saddam Iraq. According to Aljibury, the administration began coveting its Mideast neighbor's oil within weeks of the Bush-Cheney inauguration, when the White House convened a closed committee under the direction of the State Department's Pam Quanrud. The group included banking and chemical industry men, and the range of topics over what to do with a post-conquest Iraq was wide. In short order, said Aljibury, "It became an oil group."

This was not surprising as the membership list had a strong smell of petroleum. Besides Aljibury, an oil industry advisor, the secret team included executives from Royal-Dutch Shell and ChevronTexaco. These and other oil industry bigs would, in 2003, direct the drafting of a 300-page addendum to the Economy Plan solely about Iraq's oil assets. The oil section of the Plan, obtained after a year of wrestling with the administration over the Freedom of Information Act, calls for Iraqis to sell off to "IOCs" (international oil companies) the nation's "downstream" assets--that is, the refineries, pipelines and ports that, unless under armed occupation, a Mideast nation would be loathe to give up.

The General Versus Annex D

One thing stood in the way of rewriting Iraq's laws and selling off Iraq's assets: the Iraqis. An insider working on the plans put it coldly: "They have [Deputy Defense Secretary Paul] Wolfowitz coming out saying it's going to be a democratic country ... but we're going to do something that 99 percent of the people of Iraq wouldn't vote for."

In this looming battle between what Iraqis wanted and what the Bush administration planned for them, the Iraqis had an unexpected ally, Gen. Jay Garner, the man appointed by our president just before the invasion as a kind of temporary Pasha to run the soon-to-be conquered nation.

Garner's an old Iraq hand who performed the benevolent autocratic function in the Kurdish zone after the first Gulf War. But in March 2003, the general made his big career mistake. In Kuwait City, fresh off the plane from the United States, he promised Iraqis they would have free and fair elections as soon as Saddam was toppled, preferably within 90 days.

Garner's 90-days-to-democracy pledge ran into a hard object: The Economy Plan's 'Annex D.' Disposing of a nation's oil industry--let alone redrafting trade and tax laws--can't be done in a weekend, nor in 90 days. Annex D lays out a strict 360-day schedule for the free-market makeover of Iraq. And there's the rub: It was simply inconceivable that any popularly elected government would let America write its laws and auction off the nation's crown jewel, its petroleum industry.

Elections would have to wait. As lobbyist Norquist explained when I asked him about the Annex D timetable, "The right to trade, property rights, these things are not to be determined by some democratic election." Our troops would simply have to stay in Mesopotamia a bit longer.

New World Orders 12, 37, 81 and 83

Gen. Garner resisted--which was one of the reasons for his swift sacking by Secretary of Defense Donald Rumsfeld on the very night he arrived in Baghdad last April. Rummy had a perfect replacement ready to wing it in Iraq to replace the recalcitrant general. Paul Bremer may not have had Garner's experience on the ground in Iraq, but no one would question the qualifications of a man who served as managing director of Kissinger Associates.

Pausing only to install himself in Saddam's old palace--and adding an extra ring of barbed wire--"Jerry" Bremer cancelled Garner's scheduled meeting of Iraq's tribal leaders called to plan national elections. Instead, Bremer appointed the entire government himself. National elections, Bremer pronounced, would have to wait until 2005. The extended occupation would require our forces to linger.

The delay would, incidentally, provide time needed to lock in the laws, regulations and irreversible sales of assets in accordance with the Economy Plan.

On that, Bremer wasted no time. Altogether, the leader of the Coalition Provisional Authority issued exactly 100 orders that remade Iraq in the image of the Economy Plan. In May, for example, Bremer--only a month from escaping out Baghdad's back door--took time from fighting the burgeoning insurrection to sign orders 81--"Patents,"and 83, "Copyrights." Here, Grover Norquist's hard work paid off. Fifty years of royalties would now be conferred on music recording. And 20 years on Windows code.

Order number 37, "Tax Strategy for 2003," was Norquist's dream come true: taxes capped at 15 percent on corporate and individual income (as suggested in the Economy Plan, page 8). The U.S. Congress had rejected a similar flat-tax plan for America, but in Iraq, with an electorate of one--Jerry Bremer--the public's will was not an issue.

Not everyone felt the pain of this reckless rush to a free market. Order 12, "Trade Liberalization," permitted the tax- and tariff-free import of foreign products. One big winner was Cargill, the world's largest grain merchant, which flooded Iraq with hundreds of thousands of tons of wheat. For Iraqi farmers, already wounded by sanctions and war, this was devastating. They could not compete with the U.S. and Australian surplusses dumped on them. But the import plan carried out the letter of the Economy Plan.

This trade windfall for the West was enforced by the occupation's agriculture chief, Dan Amstutz, himself an import from the United States. Prior to George Bush taking office, Amstutz chaired a company funded by Cargill.

There's no sense cutting taxes on big business, ordering 20 years of copyright payments for Bill Gates' operating system or killing off protections for Iraqi farmers if some out-of-control Iraqi government is going to take it away after an election. The shadow governors of Iraq back in Washington thought of that, too. Bremer fled, but he's left behind him nearly 200 American "experts," assigned to baby-sit each new Iraqi minister--functionaries also approved by the U.S. State Department.

The Price

The free market paradise in Iraq is not free.

After General Garner was deposed, I met with him in Washington. He had little regard for the Economy Plan handed to him three months before the tanks rolled. He especially feared its designs on Iraq's oil assets and the delay in handing Iraq back to Iraqis. "That's one fight you don't want to take on," he told me.

But we have. After a month in Saddam's palace, Bremer cancelled municipal elections, including the crucial vote about to take place in Najaf. Denied the ballot, Najaf's Shi'ites voted with bullets. This April, insurgent leader Moqtada Al Sadr's militia killed 21 U.S. soldiers and, for a month, seized the holy city.

"They shouldn't have to follow our plan," the general said. "It's their country, their oil." Maybe, but not according to the Plan. And until it does become their country, the 82nd Airborne will have to remain to keep it from them.

That's what George Bush tells us. And he got that from his buddy, the strange right-wing President of Colombia, Alvaro Uribe.

So: After the fact, Colombia justifies its attempt to provoke a border war as a way to stop the threat of WMDs! Uh, where have we heard that before?

The US press snorted up this line about Chavez' $300 million to "terrorists" quicker than the young Bush inhaling Colombia's powdered export.

What the US press did not do is look at the evidence, the email in the magic laptop. (Presumably, the FARC leader's last words were, "Listen, my password is ....")

I read them. (You can read them here) While you can read it all in español, here is, in translation, the one and only mention of the alleged $300 million from Chavez:

"... With relation to the 300, which from now on we will call "dossier," efforts are now going forward at the instructions of the boss to the cojo [slang term for 'cripple'], which I will explain in a separate note. Let's call the boss Ángel, and the cripple Ernesto."

Got that? Where is Hugo? Where's 300 million? And 300 what? Indeed, in context, the note is all about the hostage exchange with the FARC that Chavez was working on at the time (December 23, 2007) at the request of the Colombian government.

Indeed, the entire remainder of the email is all about the mechanism of the hostage exchange. Here's the next line:

"To receive the three freed ones, Chavez proposes three options: Plan A. Do it to via of a 'humanitarian caravan'; one that will involve Venezuela, France, the Vatican[?], Switzerland, European Union, democrats [civil society], Argentina, Red Cross, etc."

As to the 300, I must note that the FARC's previous prisoner exchange involved 300 prisoners. Is that what the '300' refers to? ¿Quien sabe? Unlike Uribe, Bush and the US press, I won't guess or make up a phastasmogoric story about Chavez mailing checks to the jungle.

To bolster their case, the Colombians claim, with no evidence whatsoever, that the mysterious "Angel" is the code name for Chavez. But in the memo, Chavez goes by the code name ... Chavez.

Well, so what? This is what . . . .
Colombia's invasion into Ecuador is a rank violation of international law, condemned by every single Latin member of the Organization of American States. But George Bush just loved it. He called Uribe to back Colombia, against, "the continuing assault by narco-terrorists as well as the provocative maneuvers by the regime in Venezuela."

Well, our President may have gotten the facts ass-backward, but Bush knows what he's doing: shoring up his last, faltering ally in South America, Uribe, a desperate man in deep political trouble.

Uribe claims he is going to bring charges against Chavez before the International Criminal Court. If Uribe goes there in person, I suggest he take a toothbrush: it was just discovered that right-wing death squads held murder-planning sessions at Uribe's ranch. Uribe's associates have been called before the nation's Supreme Court and may face prison.

In other words, it's a good time for a desperate Uribe to use that old politico's wheeze, the threat of war, to drown out accusations of his own criminality. Furthermore, Uribe's attack literally killed negotiations with FARC by killing FARC's negotiator, Raul Reyes. Reyes was in talks with both Ecuador and Chavez about another prisoner exchange. Uribe authorized the negotiations. However, Uribe knew, should those talks have succeeded in obtaining the release of those kidnapped by the FARC, credit would have been heaped on Ecuador and Chavez, and discredit heaped on Uribe.

Luckily for a hemisphere on the verge of flames, the President of Ecuador, Raphael Correa, is one of the most level-headed, thoughtful men I've ever encountered.

Correa is now flying from Quito to Brazilia to Caracas to keep the region from blowing sky high. While moving troops to his border - no chief of state can permit foreign tanks on their sovereign soil - Correa also refuses sanctuary to the FARC . Indeed, Ecuador has routed out 47 FARC bases, a better track record than Colombia's own, corrupt military.

For his cool, peaceable handling of the crisis, I will forgive Correa for apologizing for his calling Bush, "a dimwitted President who has done great damage to his country and the world." (Watch an excerpt of my interview with Correa here.)

Amateur Hour in Blue

We can trust Correa to keep the peace South of the Border. But can we trust our Presidents-to-be?

The current man in the Oval Office, George Bush, simply can't help himself: an outlaw invasion by a right-wing death-squad promoter is just fine with him.

But guess who couldn't wait to parrot the Bush line? Hillary Clinton, still explaining that her vote to invade Iraq was not a vote to invade Iraq, issued a statement nearly identical to Bush's, blessing the invasion of Ecuador as Colombia's "right to defend itself." And she added, "Hugo Chávez must stop these provoking actions." Huh?

I assumed that Obama wouldn't jump on this landmine - especially after he was blasted as a foreign policy amateur for suggesting he would invade across Pakistan's border to hunt terrorists.

It's embarrassing that Barack repeated Hillary's line nearly verbatim, announcing, "the Colombian government has every right to defend itself."

(I'm sure Hillary's position wasn't influenced by the loan of a campaign jet to her by Frank Giustra. Giustra has given over a hundred million dollars to Bill Clinton projects. Last year, Bill introduced Giustra to Colombia's Uribe. On the spot, Giustra cut a lucrative deal with Uribe for Colombian oil.)

Then there's Mr. War Hero. John McCain weighed in with his own idiocies, announcing that, "Hugo Chavez is establish[ing] a dictatorship," presumably because, unlike George Bush, Chavez counts all the votes in Venezuelan elections.

But now our story gets tricky and icky.

The wise media critic Jeff Cohen told me to watch for the press naming McCain as a foreign policy expert and labeling the Democrats as amateurs. Sure enough, the New York Times, on the news pages Wednesday, called McCain, "a national security pro."

McCain is the "pro" who said the war in Iraq would cost nearly nothing in lives or treasury dollars.

But, on the Colombian invasion of Ecuador, McCain said, "I hope that tensions will be relaxed, President Chavez will remove those troops from the borders - as well as the Ecuadorians - and relations continue to improve between the two."

It's not quite English, but it's definitely not Bush. And weirdly, it's definitely not Obama and Clinton cheerleading Colombia's war on Ecuador.

Democrats, are you listening? The only thing worse than the media attacking Obama and Clinton as amateurs is the Democratic candidates' frightening desire to prove them right.

Bush shook Abu Risha's hand two weeks ago for the cameras. Bush can shake his hand again, but not the rest of him: Abu Risha was blown away just hours before Bush was to go on the air to praise his new friend.

Here's what you need to know that NPR won't tell you.

1. Sheik Abu Risha wasn't a sheik.
2. He wasn't killed by Al Qaeda.
3. The new alliance with former insurgents in Anbar is as fake as the sheik - and a murderous deceit.

How do I know this? You can see the film - of "Sheik" Abu Risha, of the guys who likely whacked him and of their other victims.

Just in case you think I've lost my mind and put my butt in insane danger to get this footage, don't worry. I was safe and dry in Budapest. It was my brilliant new cameraman, Rick Rowley, who went to Iraq to get the story on his own.

Rick's "the future of TV news," says BBC. He's also completely out of control. Despite our pleas, Rick and his partner Dave Enders went to Anbar and filmed where no cameraman had dared tread.

Why was "sheik" Abu Risha so important? As the New York Times put it this morning, "Abu Risha had become a charismatic symbol of the security gains in Sunni areas that have become a cornerstone of American plans to keep large numbers of troops in Iraq though much of next year."

In other words, Abu Risha was the PR hook used to sell the "success" of the surge.

The sheik wasn't a sheik. He was a fake. While proclaiming to Rick that he was "the leader of all the Iraqi tribes," Abu lead no one. But for a reported sum in the millions in cash for so-called, "reconstruction contracts," Abu Risha was willing to say he was Napoleon and Julius Caesar and do the hand-shakie thing with Bush on camera.

Notably, Rowley and his camera caught up with Abu Risha on his way to a "business trip" to Dubai, money laundering capital of the Middle East.

There are some real sheiks in Anbar, like Ali Hathem of the dominant Dulaimi tribe, who told Rick Abu Risha was a con man. Where was his tribe, this tribal leader? "The Americans like to create characters like Disney cartoon heros." Then Ali Hathem added, "Abu Risha is no longer welcome" in Anbar.

"Not welcome" from a sheik in Anbar is roughly the same as a kiss on both cheeks from the capo di capi. Within days, when Abu Risha returned from Dubai to Dulaimi turf in Ramadi, Bush's hand-sheik was whacked.

On Thursday, Bush said Abu Risha was killed, "fighting Al Qaeda" - and the White House issued a statement that the sheik was "killed by al Qaeda."

Bullshit.

There ain't no Easter Bunny and "Al Qaeda" ain't in Iraq, Mr. Bush. It was very cute, on the week of the September 11 memorials, to tie the death of your Anbar toy-boy to bin Laden's Saudi hijackers. But it's a lie. Yes, there is a group of berserkers who call themselves "Al Qaeda in Mesopotamia." But they have as much to do with the real Qaeda of bin Laden as a Rolling Stones "tribute" band has to do with Mick Jagger.

Who got Abu Risha? Nothing - NOTHING - moves in Ramadi without the approval of the REAL tribal sheiks. They were none-too-happy, as Hathem, noted, about the millions the US handed to Risha. The sheiks either ordered the hit - or simply gave the bomber free passage to do the deed.

So who are these guys, the sheiks who lead the Sunni tribes of Anbar - the potentates of the Tamimi, Fallaji, Obeidi, Zobal and Jumaili tribes? Think of them as the Sopranos of Arabia. They are also members of the so-called "Awakening Council" - getting their slice of the millions handed out - which they had no interest in sharing with Risha.

But creepy and deadly or not, these capi of the desert were effective in eliminating "Al Qaeda in Mesopotamia." Indeed, as US military so proudly pointed out to Rick, the moment the sheiks declared their opposition to Al Qaeda - i.e. got the payments from the US taxpayers - Al Qaeda instantly diappeared.

This miraculous military change, where the enemy just evaporates, has one explanation: the sheiks ARE al Qaeda in Mesopotamia. Just like the Sopranos extract "protection" payments from New Jersey businesses, the mobsters of Anbar joined our side when we laid down the loot.

What's wrong with that? After all, I'd rather send a check than send our kids from Columbus to fight them.

But there's something deeply, horribly wrong with dealing with these killers. They still kill. With new US protection, weapons and cash, they have turned on the Shia of Anbar. Fifteen thousand Shia families from a single district were forced at gunpoint to leave Anbar. Those moving too slowly were shot. Kids and moms too.

Do the Americans know about the ethnic cleansing of Anbar by our erstwhile "allies"? Rick's film shows US commanders placing their headquarters in the homes abandoned by terrorized Shia.

Rick's craziest move was to go and find these Shia refugees from Anbar. They were dumped, over a hundred thousand of them, in a cinder block slum with no running water in Baghdad. They are under the "protection" of the Mahdi Army, another group of cutthroats. But at least these are Shia cutthroats.

So the great "success" of the surge is our arming and providing cover for ethnic cleansing in Anbar. Nice, Mr. Bush. And with the US press "embedded," we won't get the real story. Even Democrats are buying into the Anbar "awakening" fairy tale.

An Iraqi government official frets that giving guns and cover to the Anbar gang is like adopting a baby crocodile. "A crocodile is not a pet," he told Rick. It will soon grow to devour you. But what could the puppet do but complain about his strings?

This Iraqi got it right: the surge is a crock.

The Bush administration made plans for war and for Iraq's oil before the 9/11 attacks sparking a policy battle between neo-cons and Big Oil, BBC's Newsnight has revealed.

Two years ago today - when President George Bush announced US, British and Allied forces would begin to bomb Baghdad - protestors claimed the US had a secret plan for Iraq's oil once Saddam had been conquered.

In fact there were two conflicting plans, setting off a hidden policy war between neo-conservatives at the Pentagon, on one side, versus a combination of "Big Oil" executives and US State Department "pragmatists."

"Big Oil" appears to have won. The latest plan, obtained by Newsnight from the US State Department was, we learned, drafted with the help of American oil industry consultants.

Insiders told Newsnight that planning began "within weeks" of Bush's first taking office in 2001, long before the September 11th attack on the US.

An Iraqi-born oil industry consultant, Falah Aljibury, says he took part in the secret meetings in California, Washington and the Middle East. He described a State Department plan for a forced coup d'etat.

Mr Aljibury himself told Newsnight that he interviewed potential successors to Saddam Hussein on behalf of the Bush administration.

Secret sell-off plan

The industry-favoured plan was pushed aside by yet another secret plan, drafted just before the invasion in 2003, which called for the sell-off of all of Iraq's oil fields. The new plan, crafted by neo-conservatives intent on using Iraq's oil to destroy the Opec cartel through massive increases in production above Opec quotas.

The sell-off was given the green light in a secret meeting in London headed by Ahmed Chalabi shortly after the US entered Baghdad, according to Robert Ebel. Mr. Ebel, a former Energy and CIA oil analyst, now a fellow at the Center for Strategic and International Studies in Washington, flew to the London meeting, he told Newsnight, at the request of the State Department.

Mr Aljibury, once Ronald Reagan's "back-channel" to Saddam, claims that plans to sell off Iraq's oil, pushed by the US-installed Governing Council in 2003, helped instigate the insurgency and attacks on US and British occupying forces.

"Insurgents used this, saying, 'Look, you're losing your country, your losing your resources to a bunch of wealthy billionaires who want to take you over and make your life miserable," said Mr Aljibury from his home near San Francisco.

"We saw an increase in the bombing of oil facilities, pipelines, built on the premise that privatization is coming."

Privatization blocked by industry

Philip Carroll, the former CEO of Shell Oil USA who took control of Iraq's oil production for the US Government a month after the invasion, stalled the sell-off scheme.

Mr Carroll told us he made it clear to Paul Bremer, the US occupation chief who arrived in Iraq in May 2003, that: "There was to be no privatization of Iraqi oil resources or facilities while I was involved."

The chosen successor to Mr Carroll, a Conoco Oil executive, ordered up a new plan for a state oil company preferred by the industry.

Ari Cohen, of the neo-conservative Heritage Foundation, told Newsnight that an opportunity had been missed to privatise Iraq's oil fields. He advocated the plan as a means to help the US defeat Opec, and said America should have gone ahead with what he called a "no-brainer" decision.

Mr Carroll hit back, telling Newsnight, "I would agree with that statement. To privatize would be a no-brainer. It would only be thought about by someone with no brain."

New plans, obtained from the State Department by Newsnight and Harper's Magazine under the US Freedom of Information Act, called for creation of a state-owned oil company favored by the US oil industry. It was completed in January 2004, Harper's discovered, under the guidance of Amy Jaffe of the James Baker Institute in Texas. Former US Secretary of State Baker is now an attorney. His law firm, Baker Botts, is representing ExxonMobil and the Saudi Arabian government.

Questioned by Newsnight, Ms Jaffe said the oil industry prefers state control of Iraq's oil over a sell-off because it fears a repeat of Russia's energy privatization. In the wake of the collapse of the Soviet Union, US oil companies were barred from bidding for the reserves.

Jaffe said "There is no question that an American oil company ... would not be enthusiastic about a plan that would privatize all the assets with Iraq companies and they (US companies) might be left out of the transaction."

In addition, Ms. Jaffe says US oil companies are not warm to any plan that would undermine Opec, "They [oil companies] have to worry about the price of oil."

"I'm not sure that if I'm the chair of an American company, and you put me on a lie detector test, I would say high oil prices are bad for me or my company."

The former Shell oil boss agrees. In Houston, he told Newsnight, "Many neo conservatives are people who have certain ideological beliefs about markets, about democracy, about this that and the other. International oil companies without exception are very pragmatic commercial organizations. They don't have a theology."

The "panel" was just two guys as qualified for the job as they are for landing the space shuttle: Dick Thornburgh and Louis Boccardi.

Remember Dickie Thornburgh? He was on the Bush 41 Administration's payroll. His grand accomplishment as Bush's Attorney General was to whitewash the investigation of the Exxon Valdez Oil spill, letting the oil giant off the hook on big damages. Thornburgh's fat pay as counsel to Kirkpatrick & Lockhart, the Washington law-and-lobbying outfit, is substantially due to his job as a Bush retainer. This is the kind of stinky conflict of interest that hardly suggests "independent." Why not just appoint Karl Rove as CBS' grand inquisitor and be done with it?

Then there's Boccardi, not exactly a prince of journalism. This is the gent who, as CEO of the Associated Press, spiked his own wire service's exposure of Oliver North and his traitorous dealings with the Ayatollah Khomeini. Legendary AP investigative reporters Robert Parry and Brian Barger found their stories outing the Iran-Contra scandal in 1986 stopped by their bosses. They did not know that Boccardi was on those very days deep in the midst of talks with North, participating in the conspiracy.

Today I spoke with Parry at his home in Virginia. He was sympathetic to Boccardi who at the time was trying to spring AP reporter Terry Anderson held hostage in Iran. But to do so, Boccardi joined, unwittingly, in a criminal conspiracy to trade guns for hostages. He then spiked his own news agency's investigation of it. Parry later discovered a 1986 email from North to John Poindexter in which North notes that Boccardi "is supportive of our terropism (sic) policy" and wants to keep the story "quiet." Poindexter was indicted, then pardoned. Boccardi was not, and there is no indication he knew he was abetting a crime. But the AP demoted journalist Barger and forced him to quit for -- the offense of trying to report the biggest story of the decade. This hardly gives Mr. Spike the qualification to pass judgment on working journalists.

And who are the journalists whom CBS has burned at the corporate stake? The first lined up for career execution is '60 Minutes' producer Mary Mapes. Besides the Bush draft dodge story, Mapes produced the exposé of the torture at Abu Ghraib when other networks had the same material and buried it.

I admit to a soft spot for Mapes. Four years ago, BBC Television London broadcast my report that Jeb Bush had wrongly purged thousands of African-Americans from the voter rolls, thereby fixing the election for his big brother. CBS Evening News ran away scared from the story, as did ABC and other US networks. This year, when Bush tried to repeat the trick, Mapes wanted to put it on '60 Minutes.' However, after the draft dodge story hullabaloo, that was not going to happen.

And what was the crime committed by Mapes and, let's not forget, Dan Rather, whose career was also toasted by the story?

CBS said, "The Panel found that Mapes ignored information that cast doubt on the story she had set out to report -- that President Bush had received special treatment 30 years ago, getting to the [Texas Air National] Guard ahead of many other applicants …."

Well, excuse me, but that story is stone cold solid, irrefutable, backed-up, sourced, proven to a fare-thee-well. I know, because I'm one of the reporters who broke that story … way back in 1999, for the Guardian papers of Britain. No one has challenged the Guardian report, or my follow-up for BBC Television, whatsoever, though we've begged the White House for a response from our self-proclaimed "war president."

CBS did not "break" this Chicken-Hawk George story; it's just that Dan Rather, with Mapes' encouragement, found his journalistic soul and the cojones, finally, after 5 years delay, to report it. Did Bush get special treatment to get into the Guard? Baby Bush tested in the 25th percentile out of 100. Yet, he leaped ahead of thousands of other Vietnam evaders because the then-Speaker of the Texas legislature sent a message to General Craig Rose, head of the Guard, to let in Little George and a few other sons of well-placed politicos.

Mapes and Rather did make a mistake, citing a memo which could not be authenticated. But let's get serious folks: this "Killian" memo had not a darn thing to do with the story-in-chief -- the President's using his daddy's connections to duck out of Vietnam. The Killian memo was a goofy little addition to the story (not included in my Guardian or BBC reports).

So CBS inquisitors took this minor error and used it to discredit the story and ruin careers of reporters who allowed themselves an unguarded moment of courage. And, crucial to the network's real agenda, this nonsensical distraction allowed the White House to resurrect the fake reputation of George Bush as Vietnam-era top gun.

CBS executives' model was clearly the hatchet job done on BBC news last year by the so-called "Hutton Report." In that case, some used-up lordship viciously attacked the BBC's ballsy uncovering of an official lie: that Saddam Hussein had weapons of mass destruction. Lord Hutton seized on a minor error by one reporter to attempt to discredit the entire BBC investigation of governmental mendacity.

In Britain, the public stood with the "Beeb." But in my own country, the American press itself, notably the New York Times, has joined in the lynch mob, repeating the allegations against the investigative reporters without any independent verification of the charges whatsoever.

I would note that neither CBS nor the New York Times punished a single reporter for passing on, as hard news, the Bush Administration fibs and whoppers about Saddam Hussein's nuclear and biological weapons programs. Shameful repetitions of propaganda produced no resignations -- indeed, picked up an Emmy or two.

Yes, I believe heads should roll at CBS: those of the "news" chieftains who for five years ignored the screaming evidence about George Bush's dodging the draft during the war in Vietnam.

At the top of the network's craven and dead wrong apology to the President is that cyclopsian CBS eyeball. But I suspect that CBS itself has little interest in eating its own flesh. This vile spike-after-broadcast serves only its master, the owner of CBS, Viacom Corporation.

"From a Viacom standpoint, the election of a Republican administration is a better deal. Because the Republican administration has stood for many things we believe in, deregulation and so on…. I vote for Viacom. Viacom is my life, and I do believe that a Republican administration is better for media companies than a Democratic one."

That more-than-revealing statement, made weeks before the presidential election, by Sumner Redstone, billionaire honcho of CBS' parent company, wasn't reported on CBS. Why not? Someone should investigate.

Viacom needs the White House to bless its voracious and avaricious need to bust current ownership and trade rules to add to its global media monopoly. Placing the severed heads of reporters who would question the Bush mythology on the White House doorstep will certainly ease the way for Viacom's ambitions.

At the least, at the upcoming inaugural parties, CBS' ruler Redstone can expect that White House occupants will give him a standing Rove-ation.

Most voters in Ohio thought they were voting for Kerry. At 1:05 a.m. Wednesday morning, CNN's exit poll showed Kerry beating Bush among Ohio women by 53 percent to 47 percent. The exit polls were later combined with—and therefore contaminated by—the tabulated results, ultimately becoming a mirror of the apparent actual vote. Kerry also defeated Bush among Ohio's male voters 51 percent to 49 percent. Unless a third gender voted in Ohio, Kerry took the state.

So what's going on here? Answer: the exit polls are accurate. Pollsters ask, "Who did you vote for?" Unfortunately, they don't ask the crucial, question, "Was your vote counted?" The voters don't know.

Here's why. Although the exit polls show that most voters in Ohio punched cards for Kerry-Edwards, thousands of these votes were simply not recorded. This was predictable and it was predicted. [See TomPaine.com, "An Election Spoiled Rotten," November 1.]

Once again, at the heart of the Ohio uncounted vote game are, I'm sorry to report, hanging chads and pregnant chads, plus some other ballot tricks old and new.

The election in Ohio was not decided by the voters but by something called "spoilage." Typically in the United States, about 3 percent of the vote is voided, just thrown away, not recorded. When the bobble-head boobs on the tube tell you Ohio or any state was won by 51 percent to 49 percent, don't you believe it ... it has never happened in the United States, because the total never reaches a neat 100 percent. The television totals simply subtract out the spoiled vote.

Whose Votes Are Discarded?

And not all votes spoil equally. Most of those votes, say every official report, come from African-American and minority precincts. (To learn more, click here.)

We saw this in Florida in 2000. Exit polls showed Gore with a plurality of at least 50,000, but it didn't match the official count. That's because the official, Secretary of State Katherine Harris, excluded 179,855 spoiled votes. In Florida, as in Ohio, most of these votes lost were cast on punch cards where the hole wasn't punched through completely—leaving a 'hanging chad,'—or was punched extra times. Whose cards were discarded? Expert statisticians investigating spoilage for the government calculated that 54 percent of the ballots thrown in the dumpster were cast by black folks. And here's the key: Florida is terribly typical. The majority of ballots thrown out (there will be nearly 2 million tossed out from Tuesday's election) will have been cast by African American and other minority citizens.

So here we go again. Or, here we don't go again. Because unlike last time, Democrats aren't even asking Ohio to count these cards with the not-quite-punched holes (called "undervotes" in the voting biz). Nor are they demanding we look at the "overvotes" where voter intent may be discerned.

Ohio is one of the last states in America to still use the vote-spoiling punch-card machines. And the Secretary of State of Ohio, J. Kenneth Blackwell, wrote before the election, “the possibility of a close election with punch cards as the state’s primary voting device invites a Florida-like calamity.”

But this week, Blackwell, a rabidly partisan Republican, has warmed up to the result of sticking with machines that have a habit of eating Democratic votes. When asked if he feared being this year's Katherine Harris, Blackwell noted that Ms. Fix-it's efforts landed her a seat in Congress.

Exactly how many votes were lost to spoilage this time? Blackwell's office, notably, won't say, though the law requires it be reported. Hmm. But we know that last time, the total of Ohio votes discarded reached a democracy-damaging 1.96 percent. The machines produced their typical loss—that's 110,000 votes—overwhelmingly Democratic.

The Impact Of Challenges

First and foremost, Kerry was had by chads. But the Democrat wasn't punched out by punch cards alone. There were also the 'challenges.' That's a polite word for the Republican Party of Ohio's use of an old Ku Klux Klan technique: the attempt to block thousands of voters of color at the polls. In Ohio, Wisconsin and Florida, the GOP laid plans for poll workers to ambush citizens under arcane laws—almost never used—allowing party-designated poll watchers to finger individual voters and demand they be denied a ballot. The Ohio courts were horrified and federal law prohibits targeting of voters where race is a factor in the challenge. But our Supreme Court was prepared to let Republicans stand in the voting booth door.

In the end, the challenges were not overwhelming, but they were there. Many apparently resulted in voters getting these funky "provisional" ballots—a kind of voting placebo—which may or may not be counted. Blackwell estimates there were 175,000; Democrats say 250,000. Pick your number. But as challenges were aimed at minorities, no one doubts these are, again, overwhelmingly Democratic. Count them up, add in the spoiled punch cards (easy to tally with the human eye in a recount), and the totals begin to match the exit polls; and, golly, you've got yourself a new president. Remember, Bush won by 136,483 votes in Ohio.

Enchanted State's Enchanted Vote

Now, on to New Mexico, where a Kerry plurality—if all votes are counted—is more obvious still. Before the election, in TomPaine.com, I wrote, "John Kerry is down by several thousand votes in New Mexico, though not one ballot has yet been counted."

How did that happen? It's the spoilage, stupid; and the provisional ballots.

CNN said George Bush took New Mexico by 11,620 votes. Again, the network total added up to that miraculous, and non-existent, '100 percent' of ballots cast.

New Mexico reported in the last race a spoilage rate of 2.68 percent, votes lost almost entirely in Hispanic, Native American and poor precincts—Democratic turf. From Tuesday's vote, assuming the same ballot-loss rate, we can expect to see 18,000 ballots in the spoilage bin.

Spoilage has a very Democratic look in New Mexico. Hispanic voters in the Enchanted State, who voted more than two to one for Kerry, are five times as likely to have their vote spoil as a white voter. Counting these uncounted votes would easily overtake the Bush 'plurality.'

Already, the election-bending effects of spoilage are popping up in the election stats, exactly where we'd expect them: in heavily Hispanic areas controlled by Republican elections officials. Chaves County, in the "Little Texas" area of New Mexico, has a 44 percent Hispanic population, plus African Americans and Native Americans, yet George Bush "won" there 68 percent to 31 percent.

I spoke with Chaves' Republican county clerk before the election, and he told me that this huge spoilage rate among Hispanics simply indicated that such people simply can't make up their minds on the choice of candidate for president. Oddly, these brown people drive across the desert to register their indecision in a voting booth.

Now, let's add in the effect on the New Mexico tally of provisional ballots.

"They were handing them out like candy," Albuquerque journalist Renee Blake reported of provisional ballots. About 20,000 were given out. Who got them?

Santiago Juarez who ran the "Faithful Citizenship" program for the Catholic Archdiocese in New Mexico, told me that "his" voters, poor Hispanics, whom he identified as solid Kerry supporters, were handed the iffy provisional ballots. Hispanics were given provbisional ballots, rather than the countable kind "almost religiously," he said, at polling stations when there was the least question about a voter's identification. Some voters, Santiago said, were simply turned away.

Your Kerry Victory Party

So we can call Ohio and New Mexico for John Kerry—if we count all the votes.

But that won't happen. Despite the Democratic Party's pledge, the leadership this time gave in to racial disenfranchisement once again. Why? No doubt, the Democrats know darn well that counting all the spoiled and provisional ballots will require the cooperation of Ohio's Secretary of State, Blackwell. He will ultimately decide which spoiled and provisional ballots get tallied. Blackwell, hankering to step into Kate Harris' political pumps, is unlikely to permit anything close to a full count. Also, Democratic leadership knows darn well the media would punish the party for demanding a full count.

What now? Kerry won, so hold your victory party. But make sure the shades are down: it may be become illegal to demand a full vote count under PATRIOT Act III.

I used to write a column for the Guardian papers in London. Several friends have asked me if I will again leave the country. In light of the failure—a second time—to count all the votes, that won't be necessary. My country has left me.

John Kerry is down by several thousand votes in New Mexico, though not one
ballot has yet been counted. He's also losing big time in Colorado and Ohio; and he's way down in Florida, though the votes won't be totaled until Tuesday night.

Through a combination of sophisticated vote rustling‹ethnic cleansing of voter rolls, absentee ballots gone AWOL, machines that "spoil" votes John Kerry begins with a nationwide deficit that could easily exceed one million votes.

The Urge To Purge

Colorado Secretary of State Donetta Davidson just weeks ago removed several
thousand voters from the state's voter rolls. She tagged felons as barred from voting. What makes this particularly noteworthy is that, unlike like Florida and a handful of other Deep South states, Colorado does not bar ex-cons from voting. Only those actually serving their sentence lose their rights.

There's no known, verified case of a Colorado convict voting illegally from the big house. Because previous purges have wiped away the rights of innocents, federal law now bars purges within 90 days of a presidential election to allow a voter to challenge their loss of civil rights.

To exempt her action from the federal rule, Secretary Davidson declared an "emergency." However, the only "emergency" in Colorado seems to be President

Why the sudden urge to purge? Davidson's chief of voting law enforcement is Drew Durham, who previously worked for the attorney general of Texas. This is what the former spokeswoman for the Lone Star state's attorney general says of Mr. Durham: He is, "unfit for public office... a man with a history of racism and ideological zealotry." Sounds just right for a purge that affects, in the majority, non-white voters.

From my own and government investigations of such purge lists, it is unlikely that this one contains many, if any, illegal voters.

But it does contain Democrats. The Dems may not like to shout about this, but studies indicate that 90-some percent of people who have served time for felonies will, after prison, vote Democratic. One suspects Colorado's Republican secretary of state knows that.

Ethnic Cleansing Of The Voter Rolls

We can't leave the topic of ethnically cleansing the voter rolls without a stop in Ohio, where a Republican secretary of state appears to be running to replace Katherine Harris.

In Cuyahoga County (Cleveland), some citizens have been caught Registering While Black. A statistical analysis of would-be voters in Southern states by the watchdog group Democracy South indicates that black voters are three times as likely as white voters to have their registration requests "returned" (i.e., subject to rejection).

And to give a boost to this whitening of the voter rolls, for the first time since the days of Jim Crow, the Republicans are planning mass challenges of voters on Election Day. The GOP's announced plan to block 35,000 voters in Ohio ran up against the wrath of federal judges; so, in Florida, what appear to be similar plans had been kept under wraps until the discovery of documents called "caging" lists. The voters on the ³caging² lists, disclosed last week by BBC Television London, are, almost exclusively, residents of African-American neighborhoods.

Such racial profiling as part of a plan to block voters is, under the Voting Rights Act, illegal. Nevertheless, neither the Act nor federal judges have persuaded the party of Lincoln to join the Democratic Party in pledging not to distribute blacklists to block voters on Tuesday.

Absentee Ballots Go AWOL

It's 10pm: Do you know where your absentee ballot is? Voters wary about computer balloting are going postal: in some states, mail-in ballot requests are up 500 percent. The probability that all those votes‹up to 15 million‹will be counted is zip.

Those who mail in ballots are very trusting souls. Here's how your trust is used. In the August 31 primaries in Florida, Palm Beach Elections Supervisor Theresa LePore (a.k.a. Madame Butterfly Ballot) counted 37,839 absentee votes. But days before, her office told me only 29,000 ballots had been received. When this loaves-and-fishes miracle was disclosed, she was forced to recount, cutting the tally to 31,138.

Had she worked it the other way, disappearing a few thousand votes instead of adding additional ones, there would be almost no way to figure out the fix (or was it a mistake?). Mail-in voter registration forms are protected by federal law. Local government must acknowledge receiving your registration and must let you know if there's a problem (say, with signature or address) that invalidates your registration. But your mail-in vote is an unprotected crapshoot. How do you know if your ballot was received? Was it tossed behind a file cabinet‹or tossed out because you did not include your middle initial? In many counties, you won't know.

And not every official is happy to have your vote. It is well-reported that Broward County, Fla., failed to send out nearly 60,000 absentee ballots. What has not been nationally reported is that Broward's elections supervisor is a Jeb Bush appointee who took the post only after the governor took the unprecedented step of removing the prior elected supervisor who happened be a Democrat.

A Million Votes In The Electoral Trash Can

"If the vote is stolen here, it will be stolen in Rio Arriba County," a New Mexico politician told me. That's a reasoned surmise: in 2000, one in 10 votes simply weren't counted‹chucked out, erased, discarded. In the voting biz, the technical term for these vanishing votes is "spoilage." Citizens cast ballots, but the machines don't notice. In one Rio Arriba precinct in the last go-'round, not one single vote was cast for president‹or, at least, none showed up on the machines.

Not everyone's vote spoils equally. Rio Arriba is 73 percent Hispanic. I asked nationally recognized vote statistician Dr. Philip Klinkner of Hamilton College to run a "regression" analysis of the Hispanic ballot spoilage in the Enchanted State. He calculated that a brown voter is 500 percent more likely to have their vote spoiled than a white voter. And It's worse for Native Americans. Vote spoilage is epidemic near Indian reservations.

Votes don't spoil because they're left out of the fridge. It comes down to the machines. Just as poor people get the crap schools and crap hospitals, they get the crap voting machines.

It's bad for Hispanics; but for African Americans, it's a ballot-box holocaust. An embarrassing little fact of American democracy is that, typically, two million votes are spoiled in national elections, registering no vote or invalidated. Based on studies by the U.S. Civil Rights Commission and the Harvard Law School Civil Rights project, about 54 percent of those ballots are cast by African Americans. One million black votes vanished‹phffft!

There's a lot of politicians in both parties that like it that way; suppression of the minority is the way they get elected. Whoever is to blame, on Tuesday, the Kerry-Edwards ticket will take the hit. In Rio Arriba, Democrats have an eight-to-one registration edge over Republicans. Among African American voters...well, you can do the arithmetic yourself.

The total number of votes siphoned out of America's voting booths is so large, you won't find the issue reported in our self-glorifying news media. The one million missing black, brown and red votes spoiled, plus the hundreds of thousands flushed from voter registries, is our nation's dark secret: an apartheid democracy in which wealthy white votes almost always count, but minorities are often purged or challenged or simply not recorded. In effect, Kerry is down by a million votes before one lever is pulled, card punched or touch-screen touched.

It lists 1,886 names and addresses of voters in predominantly black and traditionally Democrat areas of Jacksonville, Florida.

An elections supervisor in Tallahassee, when shown the list, told Newsnight: "The only possible reason why they would keep such a thing is to challenge voters on election day."

Ion Sancho, a Democrat, noted that Florida law allows political party operatives inside polling stations to stop voters from obtaining a ballot.

Mass challenges

They may then only vote "provisionally" after signing an affidavit attesting to their legal voting status.

Mass challenges have never occurred in Florida. Indeed, says Mr Sancho, not one challenge has been made to a voter "in the 16 years I've been supervisor of elections."

"Quite frankly, this process can be used to slow down the voting process and cause chaos on election day; and discourage voters from voting."

Sancho calls it "intimidation." And it may be illegal.

In Washington, well-known civil rights attorney, Ralph Neas, noted that US federal law prohibits targeting challenges to voters, even if there is a basis for the challenge, if race is a factor in targeting the voters.

The list of Jacksonville voters covers an area with a majority of black residents.

When asked by Newsnight for an explanation of the list, Republican spokespersons claim the list merely records returned mail from either fundraising solicitations or returned letters sent to newly registered voters to verify their addresses for purposes of mailing campaign literature.

Republican state campaign spokeswoman Mindy Tucker Fletcher stated the list was not put together "in order to create" a challenge list, but refused to say it would not be used in that manner.

Rather, she did acknowledge that the party's poll workers will be instructed to challenge voters, "Where it's stated in the law."

There was no explanation as to why such clerical matters would be sent to top officials of the Bush campaign in Florida and Washington.

Private detective

In Jacksonville, to determine if Republicans were using the lists or other means of intimidating voters, we filmed a private detective filming every "early voter" - the majority of whom are black - from behind a vehicle with blacked-out windows.

The private detective claimed not to know who was paying for his all-day services.

On the scene, Democratic Congresswoman Corinne Brown said the surveillance operation was part of a campaign of intimidation tactics used by the Republican Party to intimate and scare off African American voters, almost all of whom are registered Democrats.
